Accrual Calculator (Pty) Ltd runs accrual.co.za. In these terms, "we," "us," and "our" mean Accrual Calculator (Pty) Ltd.

What the service does

accrual.co.za calculates the accrual claim in a South African divorce, under the Matrimonial Property Act 88 of 1984.

You enter the inputs. The service calculates a result, seals it, and gives you a downloadable document.

The service is an automated calculation tool. It does not investigate, verify, or check whether your inputs are correct, complete, current, agreed, or legally appropriate.

The result may be wrong or incomplete if, for example, the values entered are wrong, commencement values are disputed, assets or liabilities are omitted, exclusions are misunderstood, or the parties’ matrimonial property regime has not been correctly identified.

You should not use the service for a divorce that is not subject to the accrual system, unless a qualified legal practitioner has advised you that it is appropriate to do so.

The result depends entirely on the inputs you provide. If your inputs are wrong or incomplete, the result will be too.

Using this service does not create a relationship between you and a lawyer. It is not a substitute for advice from a qualified legal practitioner.

You are responsible for checking your inputs, and for any decision you make based on a result.

You should get legal advice before using a result in court proceedings, settlement discussions, mediation, correspondence, or any binding agreement.

Buying credits

The service is billed per calculation. One credit pays for one calculation.

You buy credits before you use them.

Individuals pay the standard price per credit. Firms can buy bundles of credits at a lower price per credit.

A credit is used the moment you run and seal a calculation.

Payfast processes your payment as a single, once-off purchase. We do not offer a subscription. We do not store your card details, and we never see them.

Before you pay, we show you a summary of what you are buying, so you can check it is correct.

We will email you a receipt for each purchase. You can also see your purchase history in your account.

The price shown before payment is the total price payable for that purchase, including any applicable taxes or charges that we are required to disclose.

If you create an account, you are responsible for keeping your login details secure. You must tell us as soon as possible if you believe your account has been accessed or used without permission.

We may suspend or restrict access to an account if we reasonably believe that the account has been misused, compromised, used unlawfully, or used in breach of these terms.

Your right to cancel

If you are a consumer and the cooling-off right under South African law applies to your purchase, you may cancel your purchase of unused credits within 7 days after the date of purchase and receive a full refund for those unused credits.

This right does not apply to a credit once you have used it to run and seal a calculation. When you click to run and seal a calculation, you ask us to perform the service immediately and acknowledge that the service will be delivered at that point.

Example: You buy 5 credits and use 2 of them within a day. You can still cancel and get a refund for the 3 unused credits within 7 days of your purchase, if the cooling-off right applies.

Some users, including firms or other business users, may not have a statutory cooling-off right. Nothing in this clause gives a right to cancel where the law does not require it.

Refunds

Used credits. Once you use a credit to run and seal a calculation, that credit cannot be refunded, unless the law requires otherwise.

Unused credits. You can ask for a refund of any credits within the first 7 days. Email us at support@accrual.co.za to ask for a refund.

Refunds will be made to the original payment method where reasonably possible.

We may ask you for information to verify the purchase before processing a refund.

If we permanently discontinue the service and you still have unused credits, you may ask us to refund those unused credits.

Limits on our responsibility

We provide the service as a calculation tool. We do not guarantee that a result will be free of errors, especially where the inputs are incorrect, incomplete, disputed or based on assumptions.

To the extent the law allows, we are not responsible for indirect, consequential or knock-on losses arising from use of the service or reliance on a result. This includes lost profit, lost opportunity, legal costs, settlement decisions, litigation outcomes, or losses caused by decisions made using a result.

To the extent the law allows, our total responsibility for any claim relating to a calculation is limited to the amount you paid for that calculation.

Nothing in these terms excludes or limits any responsibility that the law does not allow us to exclude or limit. This includes liability for fraud, wilful misconduct, gross negligence, or any non-excludable rights you may have under the Consumer Protection Act or any other law.

Using the service properly

Please use the service only for lawful purposes.

Do not try to disrupt the service, copy or reverse-engineer it, or access parts of it you are not meant to.

Please only enter the personal information a calculation actually needs. See our privacy policy for more on this, including what not to enter about your spouse.

If you create an account, you must not share, sell, transfer, or allow another person to use your account without our permission.

If you are a firm, legal practitioner, mediator, financial adviser, or other professional using the service for a client, you are responsible for obtaining any client authority needed to use the service and to enter the client’s information.

Firms are responsible for their account users, for checking all inputs before a calculation is run and sealed, and for making sure that the service is used only for lawful and authorised purposes.

A result is not a legal opinion and must not be presented as legal advice from us.

We process personal information in accordance with our privacy policy.

If you enter information about another person, including your spouse or your client’s spouse, you are responsible for making sure that you are allowed to provide that information to us.

We use reasonable technical and organisational measures to protect personal information, but no online service can guarantee absolute security.

If something goes wrong

If you are unhappy with the service, contact us first at support@accrual.co.za. We will try to sort it out.

If you are a consumer under the Consumer Protection Act, you can also contact:

  • The Consumer Goods and Services Ombud, or
  • The National Consumer Commission

If your complaint is about personal information, you may also have the right to contact the Information Regulator.

Law that applies

These terms are governed by the law of South Africa. Any dispute will be handled by the South African courts.

Changes to these terms

We may update these terms from time to time. We will change the date at the top of this page when we do, and material changes will be reflected here.

If we make a material change to these terms, we will take reasonable steps to bring that change to your attention, for example by posting a notice on the website or notifying registered users.

The updated terms will apply from the date stated on the website, unless the law requires something different.
